THIS END USER LICENSE AGREEMENT IS A LEGAL AGREEMENT BETWEEN "YOU" (AN INDIVIDUAL OR A LEGAL ENTITY) (THE USER) AND MIKIRI SECURITY LLC (THE COPYRIGHT HOLDER) FOR THE "MIKIRI WAF" SOFTWARE (HEREINAFTER REFERRED TO AS THE "MIKIRI WAF SOFTWARE") DELIVERED UNDER THIS AGREEMENT.
IMPORTANT! BEFORE USING THE MIKIRI WAF SOFTWARE, PLEASE CAREFULLY READ THE TERMS OF USE CONTAINED IN THIS AGREEMENT.
INSTALLING, LAUNCHING OR OTHERWISE STARTING TO USE THE MIKIRI WAF SOFTWARE CONSTITUTES YOUR PROPER CONCLUSION OF THIS AGREEMENT AND YOUR FULL AGREEMENT WITH ALL ITS TERMS, WHICH HAVE PRIORITY OVER ANY OTHER DOCUMENT AND GOVERN THE USE OF THE SOFTWARE, EXCEPT IN THE CASE OF SIGNING AN INDIVIDUAL LICENSE AGREEMENT WITH THE COPYRIGHT HOLDER. IF YOU DO NOT AGREE TO UNCONDITIONALLY ACCEPT THE TERMS OF THIS AGREEMENT, YOU MAY NOT INSTALL OR USE THE MIKIRI WAF SOFTWARE.
1.1. Software — the above-mentioned computer program (both as a whole and its components), which is an objectively presented set of data and commands included by Mikiri Security LLC in the said computer program, as well as documentation on its use, posted on the official website accessible on the Internet at: docs.mikiri.ai (hereinafter referred to as the "Documentation"). The Mikiri WAF software is supplied in the form of installation components located in a publicly accessible repository and presented as:
the "Mikiri WAF Filter" installation package, which includes dynamic modules that connect to the web server and are designed for the primary analysis of requests, as well as auxiliary components for additional analysis of HTTP requests;
the installation package "Mikiri WAF MLC", designed for additional analysis of HTTP requests and construction of behavioral models;
the installation package "Mikiri WAF API", designed to interact with the components of the "Mikiri WAF" software;
the installation package "Mikiri WAF WNC", designed for data visualization and control of the operation of the components of the software "Mikiri WAF";
installation package "Mikiri WAF Scanner", designed to identify flaws in web applications.
1.3. Copyright holder — an individual or legal entity that has exclusive rights to the Mikiri WAF software.
1.4. User – any individual or legal entity that has purchased and uses the Mikiri WAF software.
1.5. Use of the Mikiri WAF software — any actions related to the functioning of the Mikiri WAF software in accordance with its purpose.
1.6. Software key — a key specially developed for the Mikiri WAF software, required to confirm the license of the Mikiri WAF software, its installation, and further use in order to avoid copyright infringement.
2.1. The Agreement defines the terms under which the Copyright Holder grants the User the right to use the Mikiri WAF software under a simple (non-exclusive) license.
2.2. The Mikiri WAF software is protected by copyright and the current legislation of the Russian Federation. Liability for infringement of the Copyright Holder's rights to the Mikiri WAF software shall be in accordance with the current legislation of the Russian Federation.
2.3. This Agreement does not grant ownership of the Mikiri WAF software, but only the right to use the Mikiri WAF software in accordance with the terms of this Agreement.
2.4. Technical support services for the Mikiri WAF software are provided by the Copyright Holder on the basis of a license agreement.
3.1. Use of the Mikiri WAF software for illegal or criminal purposes that violate Russian legislation is prohibited.
3.2. In accordance with the terms of the license agreement, the Copyright Holder provides a Software Key for the use of the Mikiri WAF software. The Software Key may only be used on one installed instance of the Filtering Node package. Using a single Software Key on two or more installed instances of the Filtering Node package is strictly prohibited and constitutes a violation of the terms of this Agreement.
3.3. The Copyright Holder prohibits decompiling, disassembling, or modifying files of the Mikiri WAF software that are not intended to configure the Mikiri WAF software in accordance with the Documentation, in whole or in part, except in cases provided for by applicable law.
3.4. The User is granted the right to install and use the Mikiri WAF software under a simple (non-exclusive) license, subject to compliance with the requirements of this Agreement.
3.5. The User may not transfer the rights to use the Mikiri WAF software to third parties, sell, lease, license, rent, or otherwise transfer the software or any copy, modification, or combination of software components without the written consent of the Copyright Holder.
3.6. The copyright holder shall under no circumstances be liable for any direct or indirect damage caused during the use of the Mikiri WAF software.
3.7. The simple (non-exclusive) license for the Mikiri WAF software is provided on an "as is" basis. The Copyright Holder provides no guarantees that the Mikiri WAF software will meet the User's ultimate goals and expectations, nor does it provide any other guarantees not expressly stated in this Agreement. The User assumes responsibility for selecting the Mikiri WAF software to achieve the desired results and for the results obtained during the User's use of the Mikiri WAF software.
3.8. The copyright holder reserves the exclusive right to use the Mikiri WAF software in any form and by any means.
4.1. The Copyright Holder guarantees the functionality and operability of the Mikiri WAF software, provided that:
timely installation by the User of updates to the Mikiri WAF software and updates to the software environment within and/or in conjunction with which the Mikiri WAF software operates, including updating the operating system.
sufficiency and compatibility of the hardware resources on which the Mikiri WAF software operates.
At the same time, in the event of errors occurring in the operation of the Mikiri WAF software, which become known to the Copyright Holder, the Copyright Holder undertakes to make efforts to eliminate such errors.
4.2. The copyright holder guarantees the existence of exclusive rights to the Mikiri WAF software.
5.1. The copyright holder does not establish territorial restrictions on the use of the Mikiri WAF software.
6.1. In the event of the lawful acquisition of rights to use the Mikiri WAF software, this Agreement shall enter into force upon installation of the Mikiri WAF software and shall be valid for the entire period of use within the term of the copyright to the Mikiri WAF software.
6.2. This Agreement shall terminate, and the rights to use the Mikiri WAF software shall be deemed lost by the User if the User violates any of the terms of this Agreement or if the Software Key expires, whichever occurs first.
6.3. Termination of the Agreement does not release the User or any other person from the prohibition specified in paragraph 3.3 established by the Copyright Holder.
7.1. When using the Mikiri WAF software, the current legislation of the Russian Federation governing relations in the field of intellectual property applies.
7.2. For any infringement of the Copyright Holder's rights to the Mikiri WAF software, the User shall bear civil, administrative, or criminal liability in accordance with the current legislation of the Russian Federation.
